•    "Products" refers to the goods offered for sale on our Website.
•    "Order" refers to an order placed by you for Products on our Website.
•    "Contract" refers to the legally binding agreement between you and us for the purchase of Products.

2. Acceptance of Terms
•    By accessing and using our Website and placing an Order, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you must not use our Website.   

3. Products and Descriptions
•    We make every effort to ensure that the descriptions and images of our Products are accurate. However, variations in colour, finish, and appearance may occur.
•    All Products are made to order. If a Product is made to your specific requirements or size, it is your responsibility to ensure that any information or specification you provide is accurate.
•    We reserve the right to change product descriptions and prices at any time without notice.
4. Orders and Payment
•    By placing an Order, you are making an offer to purchase the Products.
•    We will send you an email confirming receipt of your Order. This email does not constitute acceptance of your Order.
•    Your Order is accepted and a Contract is formed when we dispatch the Products and send you a dispatch confirmation email.
•    Payment must be made at the time of placing the Order. We accept credit/debit cards, PayPal, Google Pay and Apple Pay.
•    All prices are in GBP and include VAT.

5. Delivery
•    We will deliver the Products to the address provided by you during the Order process. 
•    As Products are made to order, delivery times are estimates and are not guaranteed, but we will ship your Product(s) no later than 21 days after receipt of your Order.
•    We are not responsible for delays caused by events outside our control, such as weather events, customs delays, etc.
•    If applicable, delivery costs will be displayed during the checkout process.
•    Risk of product loss passes to the customer upon delivery.

 

6. Cancellation and Returns

•    Your Right to Cancel (Consumer Contracts Regulations 2013): You have the right to cancel your Order within 14 days of receiving the Products without giving a reason.
•    To cancel, you must inform us in writing of your decision, by sending an email to themetalworksjewellery@outlook.com or using the Contact Form on this Website.
•    You must return the Products to us within 14 days of notifying us of your cancellation.
•    We will refund the full purchase price within 14 days of receiving the returned Products or evidence of their return.
•    You are responsible for the cost of returning the Products.
•    Products must be returned in their original condition and packaging.
•    Faulty or Damaged Products: If the Products are faulty or damaged upon delivery, please contact us immediately. We will offer a refund or replacement.
•    Exclusions: Certain Products may be excluded from our cancellation and returns policy, such as earrings (for hygiene reasons), personalised and/or custom order items. This will be clearly stated in the Product description.

7. Liability
•    We are not liable for any indirect, consequential, or incidental loss or damage arising from your use of our Website or the purchase of our Products. We are not liable for any personal injury resulting from your mishandling or misuse of the Products.
•    Our total liability to you for any claim arising from your use of our Website or the purchase of our Products shall not exceed the total price paid by you for the Products.   
•    Nothing in these terms will limit or exclude our liability for death or personal injury resulting from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

•    All content on our Website, including jewellery designs, images, text and logos, is our intellectual property and is protected by copyright and other intellectual property laws. 
•    You may not use our content without our express written permission.

9. Data Protection
•    We will process your personal data in accordance with our Privacy Policy, which is available on our Website.
•    We will not send you any marketing communications without your prior consent.

10. Governing Law and Jurisdiction
•    These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.   
•    Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
